(WIAT) — A Jefferson County man on death row could get a new trial.
The Alabama Court of Criminal Appeals has overturned the capital murder conviction of Jeffrey Tyrone Riggs.
Riggs was sentenced to death for the 2008 shooting of his former girlfriend Norber Payne.
He argued that jury instructions should have included comments about the state’s burden to prove that he did not act in the heat of passion.
The Court of Criminal Appeals agreed.
Friday’s ruling opens the door for Riggs to get a new trial.
