Appeals court upholds Alabama inmate’s death sentence

MONTGOMERY, Ala. (AP) — The Alabama Court of Criminal Appeals has upheld the capital murder conviction and death sentence of 34-year-old Ellis Louis Mashburn.

Mashburn was convicted of the 2002 beating and stabbing deaths of his grandmother and step-grandfather in Calhoun County. Court records show the couple, Clara Eva Birmingham and Henry Owen Birmingham, were killed during a robbery and a burglary at their home in Alexandria in Calhoun County.

The appeals court rejected Mashburn’s arguments that his counsel was ineffective and that the prosecution suppressed evidence.

Mashburn is on his second round of appeals through the court system.
