Lawsuit alleges Hoover police didn’t respond fast enough to call

HOOVER, Ala. (WIAT) — Family members of the victim of a brutal murder-suicide in Hoover are questioning whether the Hoover Police Department did enough to save her.

The questions have nothing to do with whether or not Jimmy Lee Frizzell killed his estranged girlfriend Kimberly Ozburn inside a home on Queensview Road in Hoover in March.

Hoover officers were aware of the attack that was going on inside the home, according to a lawsuit filed recently.

“They got that information from Kim herself, from her cell phone shortly before the attack started,” said attorney Carl Chamblee, who is representing Ozburn’s estate and her mother, Virginia Jamison.

The lawsuit claims negligence and wrongful death.

But the biggest problem the lawsuit raises is that the officers on the scene didn’t act quickly enough. It alleges the officers stayed outside the home for an hour and a half after getting to the scene.

“The family wants to know why they waited,” Carl Chamblee said. “It’s simple. That’s all they’ve asked from day one: why? Explain to them why they waited.”

CBS42 did speak with Hoover Mayor Gary Ivey about the lawsuit, and he said he cannot talk about the pending litigation.
