Man charged with felony murder in shooting death during attempted burglary

BIRMINGHAM, Ala. (WIAT) – A man now faces a felony murder charge in the shooting death of a 25-year-old during an attempted burglary, according to the Birmingham Police Department.

Michael Jones, 25, is charged in the shooting death of Devery Bell at an apartment on Sept. 14.

Homicide investigators gathered evidence and presented it to the Jefferson County District Attorney’s Office, which advised no charges be filed against the resident of the apartment who shot the two men as they attempted to burglarize the apartment.

Instead, the shooting was ruled justifiable because the Jones and Bell were in the act of committing a crime when the resident of the apartment shot them.

Jones, who survived the shooting, is charged with felony murder because he initiated the circumstances that led to Bell’s death.

“It’s obvious that this senseless burglary act created an even larger danger to all who were involved. The ultimate consequences of [Jones’] reckless behavior affected them and each of their families,” Birmingham Police Chief A.C. Roper said in a statement. “There truly are no winners in this case.”

Jones is being held at the Jefferson County Jail.
