We have new information in the case of a 3-year-old, recovering from a gunshot wound.

The child’s family originally told police the child found the gun hidden in between couch cushions and accidentally shot himself, but Monday Birmingham police told CBS42 that is not what happened. They say an adult somehow shot the 3-year-old. That person is now in jail.

Police arrested 24-year-old Byron Dobbins. They say he knows the family because he is the cousin of the mother’s boyfriend.

Police say after they first began investigating, they started to doubt a three-year-old could handle a gun and manage to pull the trigger by on his own. They also obtained evidence that proved he did shoot himself.

Child Services has also been called in to examine the child’s life at home and his safety.

Dobbins is currently being held at the Jefferson County Jail with a charge of 1st degree Assault. No bond has been set.
