Garrard’s attorneys file motion asking judge to recuse himself

BIRMINGHAM, Ala. (WIAT) — Joyce Garrard, the woman accused of killing her granddaughter, is asking the judge in the case to recuse himself.

Garrard’s attorneys filed a motion asking Judge Billy Ogletree to recuse himself from the murder case.

The motion questions Ogletree’s ability to handle the case fairly because he has a history with the family.

Ogletree presided over the custody hearing awarding custody of Savannah Hardin to her father, Robert.

Hardin died as a result of her grandmother and mother forcing her to run for hours as punishment.

A hearing on the motion is scheduled for April 4.
