BIRMINGHAM, Ala. (WIAT) — The attorney of the man accused of killing a 15-year-old boy in Railroad Park in 2013 wants a judge to dismiss the charges against his client.

Justin Jones’ attorney says the prosecution’s key witness has changed his story and now says he didn’t see what happened when Jermaine Walton was shot and killed in March of 2013.

There were hundreds of people at Railroad Park that day.

No one else saw the shooting that claimed Walton’s life.

Jones’ attorney says without that witness, the prosecution doesn’t have a case.
