TUSCALOOSA, Ala. (WIAT) — The case of a Tuscaloosa County teacher accused of having sex with a student has been dismissed.
However, it’s going to a grand jury. Monday, a judge dismissed a criminal charge against 28-year old Joe Petrey, after the prosecutor asked for a motion to dismiss.
“We are very happy with the outcome. It relives our client out on bond and it frees everyone else up to go and do what they want to do and be where they want,” said Petrey’s attorney, Joel Sogul.
The Brookwood High School teacher was arrested in August after photos allegedly of him with a female student were posted on the internet and sent to school officials.
“The State moved to dismiss the case. We are very pleased with that and hopefully that will be the end of it,” Sogul said.
Reportedly the district attorney’s office has sent the case to a grand jury, which could indict Petrey at a later date.
He could also be re-arrested.
