Lawsuit filed against EOS claims lip balm causes cracking, bleeding of skin

(WIAT) — A class action lawsuit has been filed against EOS, claiming the company’s lip balm causes adverse health effects.

The plaintiff, Rachael Cronin, said her lips felt like “sandpaper,” so she reapplied the product to soothe them. Cronin claims the lip balm made her lips crack, flake, blister and even bleed. The next day, Cronin said she developed a rash on and around her mouth. The lawsuit says the plaintiff’s symptoms lasted for 10 days.

EOS lip balm comes in a variety of colors and “flavors,” and is one of the most popular and widely-advertised products in the beauty market. The brands included in the lawsuit include: Blackberry Nectar, Coconut Milk, Strawberry Sorbet, Blueberry Acai, Pomegranate Raspberry, Summer Fruit, Sweet Mint, Honeysuckle Honeydew, Lemon Drop, and Medicated Tangerine.

With names like Miley Cyrus, Kim Kardashian and Brittney Spears behind the brand, the lawsuit claims that EOS has created a “viral marketing frenzy around the product.”

According to the lawsuit, Cronin provided a written complaint to EOS and was contacted by their “medical health team,” that told her the product contained nothing “inherently allergenic.” The lawsuit also says that nowhere on the EOS website, packaging, or labeling references the existence of a “medical health team,” nor does the labeling warn of potential dangers or health problems.

However, upon further investigation, it was discovered that several ingredients in EOS lip balm can cause allergic reaction:

  • Sodium Hyaluronate, a common lip “puffer”
  • Shea butter, which is derived from nuts and considered a “major food allergen”
  • Ascorbyl palmitate
  • Tocopherols (TCP)
  • Stevia Extract

TIME reports that Cronin’s lawyer Mark Geragos believes EOS lip balm “could potentially harm tens of thousands if not hundreds of thousands of shoppers.” Geragos is seeking damages and asking EOS to address the potential health concerns.

EOS released a statement on their official Facebook page saying:

“Some of you may have seen reports of a lawsuit filed against our company. We wanted to be sure that you, our valued customers and fans, know that the health and well-being of our customers is our top priority. Our products are safe to use, are made with the highest quality ingredients and they all meet or exceed all safety and quality standards set out by our industry. An independent laboratory puts each of our products through a battery of rigorous testing to ensure this is the case. For these reasons, we firmly believe this lawsuit is without merit, and we will continue to create new and exciting products that delight our customers. Thank you. EOS”
