(WIAT) — There’s a new development in the Dylann Roof trial. His legal team has filed a legal challenge over the use of the death penalty.
Roof’s attorney filed a 40 page motion Monday night. He argues that the death penalty is unconstitutional because of a high rate of conviction errors and the years that pass between conviction and execution, among other things.
The government has until August 21 to respond.
Roof is facing a total of 45 charges for killing 9 church members in Charleston, South Carolina last year.
