MONTGOMERY, Ala. (AP) — A special Supreme Court is being named to hear suspended Chief Justice Roy Moore’s appeal to return to the bench.
The seven judges for Moore’s appeal will be selected at 3 p.m. Thursday from a pool of retired appellate, circuit and district judges.
A judicial panel last month suspended Moore for the remainder of his term after finding he urged state probate judges to defy the federal courts on gay marriage. Moore is appealing the decision.
Sitting justices recused themselves from hearing Moore’s appeal. Acting Chief Justice Lyn Stuart set out the process for the selection of replacement judges in a Tuesday order.
Moore supporters have objected to Stuart’s involvement because she ordered Moore to empty out his office. Moore’s attorney said that directive was premature since Moore is appealing.
