State asks U.S. Supreme Court to allow execution of inmate

ALABAMA (WIAT) — UPDATE: 45-year-old Ronald Bert Smith, Jr. was pronounced dead at 11:05 p.m. on Thursday after a lethal injection.

He had no final words.

ORIGINAL: The state is asking the U.S. Supreme Court to allow the execution of an inmate. Ronald Bert Smith, Jr. is set to die by lethal injection on Thursday.

Attorney General Luther Strange’s office asked the justices in papers on Tuesday to deny a stay requested by Smith. He is convicted of killing Huntsville store clerk in 1994.

A judge imposed death after jurors recommended life without parole. Smith says that conflicts with a Supreme Court decision earlier this year from Florida.

The state argues that the Florida decision does not apply to Smith’s case and he waited too long to raise objections.
